The deal.

A short, plain-language agreement. By using Yewmark you agree to it. If anything’s unclear, write to [email protected].

At a glance

You can use Yewmark if you’re 16 or older. Your words are yours; we don’t train AI on them. Paid plans renew monthly until you cancel; EU/UK consumers get a 14-day cooling-off window. The AI is a thinking partner, not a therapist. Be reasonable in how you use the service, and we’ll be reasonable with you.

What follows is the detailed agreement.

Who we are and what Yewmark is

Yewmark (yewmark.com) is an AI-assisted personal journaling web app, operated by an individual in the US Midwest, with infrastructure in the Netherlands. “Yewmark”, “we”, “us”, and “our” in these terms refer to that operator. “You” means the person using the service.

Eligibility and your account

You must be at least 16 years old to create an account. Yewmark is for individuals — one human per account, no shared logins, no automated/bot use without our written permission.

You agree to give us a real email and to keep your password private. You’re responsible for what happens through your account. If you think someone else has accessed it, change your password (using Forgot password) and contact us. A password reset invalidates every existing session.

Your content

Your entries belong to you. We claim no ownership. We do need a limited license to hold them, show them back to you, route them to the AI provider you’ve chosen for digest/chat, back them up, and (where the law requires) preserve them for short windows in the abuse and account-lifecycle flows. That license is the minimum needed to operate the service; it ends when you delete the data or the account. We do not, ever, use your entries to train AI models. You’re responsible for the legality of what you write. You agree not to use Yewmark to store or transmit content that is illegal in the jurisdiction where you live — child sexual abuse material, content that incites violence, stolen credentials, malware, or anything that infringes someone else’s intellectual property. If we become aware of such content we will remove it and may report it to the appropriate authorities where the law requires.

Acceptable use

You agree not to:

  • Use Yewmark for spam, harassment, or activity targeted at someone other than yourself.
  • Attempt to access another user’s account, data, or content.
  • Probe, scan, or test the system’s vulnerabilities; reverse-engineer it; or run automated tools against it. Good-faith security research is welcome — write to us first.
  • Use the AI features to bypass content policies of the underlying providers, or to generate material that would violate them.
  • Resell access to Yewmark, or use it on behalf of a third party, without our written permission.
  • Take any action intended to overload, degrade, or disrupt the service.

If you breach this section, we may suspend or terminate your account with reasonable notice — or immediately, in cases where notice would defeat the purpose (active abuse). We try to ask questions before pulling the plug.

Paid plans, renewals, refunds

Paid plans are billed monthly via Stripe. Your subscription renews automatically until you cancel. Cancel any time from Settings; your plan stays active through the end of the period you’ve already paid for, and you won’t be charged again.

14-day refund window (everyone, not just EU/UK).Within 14 days of any paid charge, you can request a complete refund for any reason — no questions, no usage caveat, no fine print. EU/UK consumers have this right under the Consumer Rights Directive and Consumer Contracts Regulations; we extend the same window to every paying user voluntarily. To use it, cancel from Settings and email [email protected] with “refund” in the subject. We aim to process refunds within five working days.

Beyond 14 days.If you were charged in error, write to us — we’ll refund. If your experience has been poor, write to us — we’ll either make it right or refund your most recent payment (your choice), without quibbling about usage.

Price changes.We may change plan prices. We’ll email you at least 30 days before a change to a plan you’re currently on. You can cancel before it takes effect.

The honest part about AI

The AI features (digest, chat, daily summary, weekly thread) are powered by third-party language models. They sometimes get things wrong, misread tone, or produce text that doesn’t fit. Treat AI insights as a second voice to think alongside — not therapy, medical advice, legal advice, financial advice, or final judgment. AI outputs are provided as is, without warranty of accuracy, completeness, or fitness for any particular purpose.

If you’re in crisis or in danger, please contact a real person or a real crisis line (988 in the US, samaritans.org in the UK and Ireland, findahelpline.com worldwide). Yewmark is a journal, not a hotline.

Service availability

Yewmark is a small operation. We aim for high uptime but we don’t offer a formal SLA. The service is provided as is and as available, without warranty of fitness for any particular purpose. We do not warrant that the service will be uninterrupted or error-free, or that AI responses will always be generated successfully.

We’ll give reasonable notice of planned maintenance that affects you, where reasonably possible.

Termination

By you.Delete your account from Settings any time. Soft-delete starts a 7-day grace window; sign back in within that window to undo. After the grace window, all your data is purged, and any active subscription is cancelled. (We flip Stripe to cancel-at-period-end on soft-delete so a renewal isn’t charged while you’re inside the grace window; signing back in re-enables the subscription.)

By us.We may suspend or terminate your account if you breach these terms or if we reasonably conclude that doing so is necessary to protect the service, our other users, or ourselves from harm. Where we do this for cause, you’ll be given an explanation and (where appropriate) an opportunity to remedy. We may also discontinue the service entirely with at least 60 days’ notice and an opportunity to export your data.

Liability

To the maximum extent allowed by law, our total liability to you for any claim arising from your use of Yewmark is limited to the greater of (a) the amount you’ve paid us in the 12 months before the claim arose, or (b) US$50. Neither party is liable for indirect, incidental, special, or consequential damages.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be limited. EU and UK consumers retain their statutory rights.

Indemnification

You agree to indemnify and hold us harmless from any third-party claim arising from your breach of these terms, your misuse of the service, or content you submit to Yewmark in violation of these terms. This obligation does not apply where prohibited by your local consumer-protection law.

Force majeure

We are not liable for any failure to perform that’s caused by events outside our reasonable control: provider outages, internet disruption, government action, denial-of-service attacks, fire, flood, and so on. We’ll do what we reasonably can to restore the service.

Changes to these terms

We may update these terms. If a change materially affects your rights or your money, we’ll email you and surface it in-app before it takes effect. Continued use after the effective date means you accept the change; if you don’t, you can delete your account.

Governing law and disputes

These terms are governed by the laws of the State of Illinois, United States, without regard to conflict-of-law principles. Nothing here affects mandatory consumer-protection law that applies where you live; EU and UK consumers in particular retain their statutory rights regardless of this clause.

If we can’t resolve a dispute by email, proceedings may be brought in the state or federal courts located in Illinois, or — where consumer-protection law permits — in the courts of your country of residence.

General

Entire agreement. These terms, together with the privacy notice, are the full agreement between you and us about Yewmark.

Severability. If a clause is found unenforceable, the rest of the agreement remains in effect.

No waiver.Our failure to enforce a right doesn’t waive it.

Assignment. You may not assign your account or these terms without our consent. We may assign these terms to a successor entity (for example, on incorporation as a limited company) with notice to you.

Notices. We send legal and account-related notices by email to the address on your account. Keep it current.
